Peachly provides a software platform (“the Platform”) that guides founders and small business owners through a structured marketing framework, along with related digital resources, guides, templates and educational materials (“Digital Resources”). The Platform may be offered as a one-time purchase, an ongoing subscription, or a combination of both, as described at the point of purchase.
To access certain features of the Platform, you must create an account. You are responsible for maintaining the confidentiality of your login details and for all activity that occurs under your account. You must provide accurate information when creating your account and keep it up to date.
Where a product is offered on a subscription basis:
Where you are offered a founding member rate, that rate is locked in for as long as your subscription remains active and is not cancelled. If you cancel your subscription and later resubscribe, the founding member rate may no longer be available.
One-time purchases and Digital Resources are final by default due to their instant-access nature. Subscription plans are governed by the Subscriptions and Billing section above.
Where a specific product or promotion includes its own guarantee or refund terms, those terms will be stated clearly on that product's sales page and take precedence over this section for that product only.
Payments are processed through third-party providers including Stripe. Peachly does not store or have access to your bank or full card details.
By becoming a Peachly customer, you grant permission for Peachly to reference your business name, logo, trademarks and a general description of the work completed or results achieved for portfolio, case study and marketing purposes across the website, social media, email and promotional materials.
Confidential information or non-public metrics will not be shared without prior written consent. If you require confidentiality beyond this, it must be agreed in writing before you begin using the Platform.
To the fullest extent permitted by law, Peachly is not liable for indirect, incidental or consequential damages arising from use of its services, Platform or products.
Peachly provides a software platform, educational resources and digital products designed to support marketing strategy and business development. All content and materials are provided for informational and educational purposes only.
Peachly does not guarantee specific business results, income levels, sales performance or financial outcomes. Any examples, case studies or strategies shared are illustrative only. Your results depend on multiple factors including your own execution, offer quality, pricing, audience, business decisions and external market conditions.
Use of this website, the Platform, its content and any digital resources is at your own discretion and risk. While reasonable care is taken to provide accurate information, Peachly makes no warranties or representations regarding uninterrupted access, error-free functionality, or the suitability of the materials for any particular purpose.
Peachly is not responsible for performance issues, outages or disruptions caused by third-party platforms or service providers, including but not limited to Stripe, hosting providers, email platforms, analytics tools, Anthropic's Claude API, or other external software. Any such issues are governed by the terms of the relevant third-party provider.
Where permitted by law, Peachly may suspend or restrict access to the Platform or its services if these Terms are breached.
These Terms of Service are governed by the laws of New Zealand.
